Juste après la révolution et, surtout, après le retour de Rached Ghannouchi (leader du parti Nahdha) au pays, un débat, voir une polémique, à propos de la laïcité s’est installé partout: Journaux, réseaux sociaux …
Le débat qui devrait être un débat autour du concept d’Etat à choisir est vite devenu un débat d’accusation: Les laïques sont accusés d’être anti-islamistes (voir même athées), les anti laïcité sont accusés d’être des extrémistes et anti-liberté!!!
Pire et encore plus dangereux et inquiétant, on a le sentiment que le débat se déroule entre Pro Nahdha et Anti Nahdha excluant par la même tout le reste des composantes de ce pays.
Plus catastrophique: une grande ignorance règne à propos du concept même de laïcité.
Après un choix de non participation au débat, et sans se placer comme prôneur de leçons, il est de notre devoir de participer d’une autre manière en essayant de clarifier le cadre de la question.
Ce n’est pas une prétention de juristes, mais une réalité: la laïcité est une affaire de juristes, en premier lieu.
Parler de laïcité c’est se situer avant tout dans le cadre du phénomène constitutionnel du système politique. Ainsi, si l’Etat existe et s’est doté d’une constitution, c’est aussi un Etat qui a choisi la forme républicaine.
La République. Mot magique et plein de significations.
Cette république a des caractéristiques: unie, indivisible, démocratique…et laïque, entre autre.
Ainsi, la laïcité est une caractéristique particulière du système constitutionnel français par l’effet de la loi du 9/12/1905 sur la séparation de l’église et de l’Etat.
Paradoxalement, cette même laïcité reste l’un des caractères les plus contestés de la République française.
Comment se traduit la laïcité républicaine? La république assure l’égalité des citoyens devant la loi sans discrimination de religion. Mais la manifestation la plus éclatante de la laïcité se situe au niveau de l’enseignement. Le Conseil D’Etat avait affirmé que le principe de la laïcité de l’enseignement est un élément de la laïcité de l’Etat (arrêt 10/3/1995, Aoukili, AJDA 1995, 332.).
Vous pouvez parcourir tout ce qui a été écrit à propos de cette notion et vous allez remarquer que son terrain d’élection été presque cerné dans L’enseignement.
La république Tunisienne telle que instaurée par la constitution de 1959 n’été pas réellement une république laïque.
Pour preuve:
Article premier: La Tunisie est un Etat libre, indépendant et souverain: sa religion est l’Islam, sa langue l’arabe et son régime la république.
Article 40: Peut se porter candidat à la Présidence de la République tout tunisien, jouissant exclusivement de la nationalité tunisienne, de religion musulmane…
Sans oublier le préambule:
Nous, représentants du peuple Tunisien, réunis en assemblée nationale constituante.
Proclamons la volonté de ce peuple…:
· de demeurer fidèle aux enseignements de l’Islam, …
l’Etat tunisien n’été pas réellement un Etat laïque au sens épistémologique mais plutôt un Etat moderne et modéré qui tend à prôner un Islam souple et approprié aux exigences du développement adéquat au peuple Tunisien.
C’est pour cette raison et sur ce fondement que l’Etat tunisien veillait à assurer une éducation religieuse (attarbia el islamia) tout au long des cycles de l’enseignement primaire et secondaire.
C’est sur ce fondement aussi que l’Etat tunisien prenait en charge la gestion des mosquées et les autres lieux de culte allant même à contrôler les discours des imams (khotabs) tenus le vendredi.
La Laïcité lui aurait interdit cette action.
Et le choix n’été pas hasardeux.
C’est un choix de surveillance et de protection, en même temps.
Surveillance, car le fikh et la philosophie (dite) islamique été tellement variée que le risque de l’apparition d’une interprétation extrémiste de la chariaa été réel. Ceux et celles qui avaient l’occasion de lire l’histoire de la Tunisie le savent très bien. Kairouan en a souffert durant une période de jadis.
Protection, surtout contre la dénaturation de l’Islam, et beaucoup de jurisconsultes musulmans, partout, ont mis en garde contre ce risque après avoir constaté la circulation d’ouvrages, manuels et même des livres de Coran falsifiés et dénaturés.
Si l’Etat été laïque, cette action aurait été laissée aux religieux qui restent impuissants. Seul l’Etat par sa puissance de contrainte pouvait le faire.
Aujourd’hui, les croisades menées contre l’Islam, les musulmans et la terre où ils y vivent nous viennent de partout.
Aujourd’hui, personne ne peut nier l’action sioniste qui vise à dénaturer notre religion.
Aujourd’hui, personne ne peut nier que ces actions offensives et agressives ne sont plus menées par les autorités qu’on connaît (Mossad Cia…et autres) mais surtout, et malheureusement, par des sous traitants locaux.
Aujourd’hui, tout le monde a assisté à la main mise de certains groupes sur les mosquées du pays avec des discours nouveaux et des rites qui nous sont étrangers. Si l’Etat doit être laïque, on ne peut rien faire. La laïcité veut que la gestion des lieux de culte n’est pas son affaire.
Aujourd’hui, si on tient à un Etat laïque, on doit supprimer l’enseignement “Tarbia islamia ou dinia” et la laisser aux personnes autres qui peuvent enseigner à nos enfants que toute personne qui n’est pas musulman est un kefer qu’il faut supprimer. L’Etat ne pourra jamais intervenir.
Ils pourront aussi les enseigner que l’Etat est un concept non islamique car le seul qu’on y croit est le khalifat et donc, faut combattre l’Etat et la détruire.
La laïcité dans notre pays (et les pays arabo-musulmans) pourrait profiter avant tout aux ennemis de la liberté et de l’Islam, le vrai et le pure.
Alors, avant de débattre, faut-il savoir de ce qu’on est entrain de foutre.
Mieux est de penser à l’Etat Patrie…qui pourrait être le fruit de la révolution tunisienne. Mais en attendant, pensons Citoyen

Lorsque l’on est juriste et que l’on veut écrire une note intéressante et objective, on ne s’y prend pas de cette façon. On explique vraiment. On ne prend pas l’exemple français pour démontrer les aspects négatifs. On explique, et ensuite, si on veut donner des exemples, on en donne plusieurs. Il y a l’exemple Turque. En Turquie, qui s’occupe donc des mosquées?
Et si on adopte la laïcité en Tunisie, pourquoi copierions-nous le modèle français?
Sommes-nous donc incapables de créer notre propre modèle?
N’avons-nous nos propres capacités intellectuelles pour pouvoir adapter une notion quelconque à notre propre société?
Heureusement que nous avons des juristes qui en sont capables, et je les ai rencontrés.

Pourquoi tu ne nous parles pas de cet exemple puisque tu en connais? Tu aurais enrichir le débat au lieu de polémiquer sans rien avancer

Vas-y…Donnes nous ce que ces juristes que tu as rencontré ont évoqué et théorisé..
5- Madame, avec tout le respect, si tu considères que le juriste doit fatalement adopter ton analyse et que s’il ne le fait pas tu lui nies toute aptitude à en discuter, je peux t’affirmer que tu adoptes la pire attitude des ennemis de la liberté.
